Terms and Conditions of Use

1. Introduction

Welcome to the Dibujalia Media web service (hereinafter, "Dibujalia" or "the website").

The use of Dibujalia implies the acceptance of and adherence to all our Terms of Use and our Privacy Policy. We recommend that you read them carefully.

Our Services consist of storing and displaying drawings, photographs, and illustrations from users. Consequently, additional product conditions or requirements (including age restrictions) may apply at times. These additional conditions will be available alongside the relevant Services and will form part of your agreement with Dibujalia upon using our services.

2. Definition of the Dibujalia Service

The Dibujalia Service consists of the insertion by the user of images, photographs, and files (PDF, AI, etc.) for display and, where applicable, sale. Dibujalia reserves the right to distribute, in whole or in part, the images published on the site through third-party portals, as well as other websites such as social networks or blogs, a condition which the Advertiser hereby accepts.

3. Use of the Portal and its Services

The user agrees to use Dibujalia, its content, and its services in accordance with:

• The Law or any other regulations of the applicable legal system.

• These Terms of Use.

• The rule: "obscene or offensive photographs for users will not be permitted."

• Good customs and public order.

• The copyright of the images.

Furthermore, the User expressly agrees not to destroy, alter, disable, or otherwise damage the data, programs, electronic documents, or other assets found on Dibujalia.com.

The User agrees not to obstruct other users' access to the service through the massive consumption of the computer resources through which Dibujalia provides the service, nor to perform actions that damage, interrupt, or generate errors in said systems.

The User agrees not to transmit, introduce, disseminate, or make available to third parties any type of material or information (programs, viruses, macros, Applets, ActiveX controls, data, content, drawings, sound, and image files, etc.) that are contrary to the law, public order, or that cause or are likely to cause any type of alteration to the computer systems of Dibujalia or third parties.

The User must publish their images in the appropriate category and provide all information deemed suitable for each image. The User specifically agrees:

• Not to incite illegal actions.

• Not to disseminate defamation, slander, insults, and/or content or propaganda of a racist or xenophobic nature, apology for terrorism, or anything that violates human rights.

• Not to impersonate other users by using their access codes.

• Not to use fictitious emails to publish images.

• Not to disseminate unsolicited or unauthorized communications (spam).

• Not to disseminate messages that attack the dignity of third parties or are rude/disrespectful.

• Not to use robots, spiders, scrapers, or any other automated means to access the Portal to copy, remove, renew, or publish content without prior written consent from Dibujalia.

• Not to use any multi-posting tool not expressly authorized. In case of breach, the portal may terminate the service without notice and without refunding contracted services.

• Not to collect personal data from third parties without consent.

• Not to bypass or circumvent measures used to restrict access to Dibujalia.

The administrator reserves the right to refuse or delete any image that violates any of the rules described above.

4. Intellectual and Industrial Property

Dibujalia hosts both its own content and user-generated content. Dibujalia is protected by intellectual property laws and international treaties. The content displayed on or through the website is protected as a collective work and/or compilation.

Unless authorized by Dibujalia or legally permitted, the user may not copy, modify, distribute, sell, or exploit the Portal's content (except for the user's own content). Reverse engineering or attempting to obtain the source code is strictly prohibited.

By uploading photographs or drawings, the user retains all rights to the images and only grants the portal the rights to:

1. Advertise the website itself.

2. Advertise the user's own images.

3. Transfer rights to the buyer under the conditions stipulated in the purchase.

4. Display images with a watermark; if downloaded without purchase, they will retain said watermark.

The user guarantees they are the full owner of the rights granted to Dibujalia and that the use of these images does not violate the rights of any third party, agreeing to indemnify Dibujalia in case of infringement.

5. Exclusion of Warranties and Liability

1. Availability: Dibujalia does not guarantee the continuous availability or access to the Portal. Within legal limits, Dibujalia is not responsible for damages resulting from service interruptions.

2. Content: Dibujalia is only responsible for services it provides directly and content identified with its own copyright. It is not responsible for acts of God (force majeure) or improper user equipment configuration.

3. Third Parties: Dibujalia does not control or guarantee the absence of viruses in third-party content. It is not liable for acts committed by other users or damages resulting from the negligent use of email accounts.

Since the service is free, Dibujalia holds no liability for the deletion, cancellation, or loss of published images and will not be required to compensate the user in such events.

9. Right to Limit or Terminate Service

Dibujalia reserves the right, at its discretion and at any time, to reject any image or remove any image from the website without prior notice.

10. Miscellaneous

1. Modifications: Dibujalia reserves the right to modify the website and these Terms of Use at any time. Users are subject to the terms in effect at the time of access.

2. Pricing: Services are free; the Portal only receives a commission on sales (currently set at 10%).

3. Minors: Minors must obtain prior authorization from parents or guardians. Access to purchase processes is restricted to those over 18. For free informative use with registration, the minimum age is 14.

11. Duration and Termination

The service is provided indefinitely. However, Dibujalia is entitled to terminate or suspend the service unilaterally at any time without notice.

12. Jurisdiction

The applicable law is Spanish law. For any dispute, the parties submit to the jurisdiction of the Courts and Tribunals of the city of Albacete (Spain), waiving any other jurisdiction.

Posting Rules

Images must respect the law, good customs, and public order. Dibujalia reserves the right to determine when an image goes against the spirit of the web.

• Complete all required fields (*).

• Use appropriate categories.

• No fictitious emails or unrelated keywords.

• No explicit sexual, erotic, or pornographic content.

• No fictitious prices to manipulate search rankings.

Security Tips:

• Never share your account or use the same password for multiple sites.

• Never share your password via email or phone.

• Always log out before leaving a computer unattended.

• Avoid accessing your account from public computers (e.g., Internet cafes).
